Children
Reaching an agreement on parenting arrangements after separation can be difficult. By engaging a professional lawyer to act on your behalf, we can make this process less stressful and also give you the reassurance that you will be provided with reliable and trustworthy advice to aid in resolving your family law matter and find the best solution.
Ross & Robins Lawyers can assist you with negotiating with the other party to reach an agreement, preparing parenting plans and Consent Orders, and acting on your behalf at mediation and/or in court. Family law matters are not always required to attend court to reach an agreement. Where possible, family law matters can be solved through negotiation and mediation. For more information on mediation, please download the Queensland Law Society’s Alternative Dispute Resolution Brochure.
Property Settlements
When separating, there are a number of important issues to be considered in regards to the division of property. While some parties may reach an agreement in regards to the division of property themselves without the advice of solicitors or any formal agreement, it is important to seek independent legal advice, to ensure that the division of property is just and equitable. If it is not, one party may dispute the agreement at a later stage and may have a claim on any marital property or property of a de facto relationship. In order to minimise the possibility of future risk, it is important to seek legal advice and to have a formal agreement prepared.
Ross & Robins Lawyers can assist you by advising of your rights, negotiating on your behalf, preparing formal agreements (including Consent Orders or Binding Financial Agreements) and representation in mediation and/or representation in court if required.
Binding Financial Agreements
Binding Financial Agreements are documents which state how property will be distributed at the end of a relationship. Binding Financial Agreements can be prepared before marriage (or before cohabitation), during a relationship or after separation.
Divorce
Ross & Robins Lawyers may assist you in your application for divorce and representation in court if required. We can assist by taking the hassle out of the process by preparing the application which must meet specific requirements of the court and serving the documents on your former partner.
